Furniture Mart, USA, Inc. Data Breach Class Action Settlement

August 28, 2026 – A proposed class action settlement has been reached in the United States District Court for the District of South Dakota resolving claims arising from a November 2024 data breach involving Furniture Mart, USA, Inc. (“FMUSA”).

The lawsuit, styled In re: Furniture Mart, USA, Inc., Data Breach Litigation, Case No. 4:25-cv-04018-RAL, alleges that a targeted cyberattack on FMUSA’s computer systems resulted in unauthorized access to files containing personal information, which may have included names, Social Security numbers, and dates of birth. FMUSA denies any wrongdoing, and the Court has not determined which party is correct.

The settlement class generally consists of individuals residing in the United States whose personal information was potentially compromised in the data breach. Under the proposed settlement, eligible class members may claim three years of credit monitoring and identity protection services, reimbursement of up to $4,500 for documented losses, up to $100 for lost time spent responding to the breach, or an alternative cash payment of $75.

The deadline to submit a claim is November 3, 2026. The deadline to object to or request exclusion from the settlement is October 5, 2026. The Court has scheduled a Final Approval Hearing for November 9, 2026, at 10:00 a.m. Central Time.

The Court appointed William B. Federman and Jessica A. Wilkes of Federman & Sherwood, along with Ellzey Kherkher Sanford Montgomery, LLP, to represent the Settlement Class.
