Enterprise Financial Group Data Breach Class Action Moves Forward Following Federal Court Ruling

October 6, 2026 – Federman & Sherwood secured a favorable ruling in a data breach class action against Enterprise Financial Group, Inc., after the United States District Court for the Northern District of Texas denied the company’s motion to dismiss the plaintiff’s negligence claim.

The lawsuit, Richard Lowman v. Enterprise Financial Group, Inc., arises from a February 2024 data breach that allegedly exposed personally identifiable information and private health information, including names, dates of birth, medical information, and health insurance information.

In its September 30, 2026 ruling, the Court found that the plaintiff sufficiently alleged that Enterprise Financial Group owed a duty to reasonably safeguard the sensitive information it collected and that the alleged failure to implement appropriate security measures could support a negligence claim. The Court also found sufficient allegations connecting the breach to the plaintiff’s claimed injuries, allowing the negligence claim to move forward.

Federman & Sherwood is pleased with the Court’s ruling and will continue pursuing the claims on behalf of the plaintiff and proposed class.
