Alpine Ear, Nose, and Throat, PLLC Group Data Breach – Investigated by Federman & Sherwood
Oklahoma City, Oklahoma (July 18, 2025) – The law firm of Federman & Sherwood announces a recent court ruling in the ongoing class action lawsuit against Alpine Ear, Nose, and Throat, PLLC. On July 17, 2025, the District Court of Larimer County, Colorado issued an order denying in part Alpine’s Motion to Dismiss, allowing key claims related to a November 2024 data breach to proceed.
The lawsuit stems from a data breach incident in which personal information was allegedly compromised. The Plaintiff asserts claims including negligence, negligence per se, invasion of privacy, breach of implied contract, breach of fiduciary duty, unjust enrichment, and a request for declaratory judgment.
Alpine sought to dismiss the case, arguing a lack of standing and failure to state claims. The Court rejected Alpine’s arguments concerning standing, finding that the Plaintiff adequately alleged injury-in-fact—including receipt of spam communications, diminished data value, time lost responding to the breach, and emotional distress—sufficient to establish legal standing under Colorado law.
Importantly, the Court also ruled that seven of the eight asserted claims were sufficiently pled and may proceed, concluding that the allegations met the plausibility standard required under Colorado’s Civil Rules. The only claim dismissed was for breach of confidence, which the Court found is not recognized as an independent cause of action under Colorado law.
