Academic Urology and Urogynecology of Arizona Data Breach Class Action Moves Forward Following Favorable Court Ruling

October 12, 2026 – Federman & Sherwood secured a favorable ruling in a data breach class action against Academic Urology and Urogynecology of Arizona, P.C., after the Superior Court of Arizona in Maricopa County denied the defendant’s motion to dismiss the plaintiffs’ Second Amended Consolidated Class Action Complaint in its entirety.

The lawsuit, Kim Miller v. Academic Urology and Urogynecology of Arizona, P.C., Case No. CV 2025-024879, arises from an alleged ransomware attack involving sensitive patient information.

In its October 6, 2026 ruling, the Court found that the plaintiffs sufficiently alleged that Academic Urology undertook a duty to safeguard patient information and that its alleged failure to implement reasonable security measures could support their claims.

Significantly, the Court allowed all three claims of negligence, breach of implied contract, and violations of the Arizona Consumer Fraud Act to proceed. The defendant must now answer the complaint, allowing the litigation to move forward.

Federman & Sherwood will continue pursuing the claims on behalf of the plaintiffs and proposed class.
