Jack’s Family Restaurants Preliminary Approval of Class Action Settlement
June 28, 2026 – Federman & Sherwood announces that the United States District Court for the Northern District of Alabama has granted preliminary approval of the proposed class action settlement in the data breach litigation against Jack’s Family Restaurants LP. The Court also appointed William B. Federman of Federman & Sherwood as Class Counsel to represent the interests of the nationwide settlement class.
The lawsuit arises from a data security incident that allegedly compromised the private information of individuals associated with Jack’s Family Restaurants. The Court preliminarily certified, for settlement purposes, a nationwide class consisting of all persons residing in the United States whose private information was compromised by the data incident, including those who received notice of the breach.
In its Order, the Court found that the proposed settlement is likely to be fair, reasonable, and adequate, and that the requirements for class certification under Federal Rule of Civil Procedure 23 are satisfied for settlement purposes. The Court also approved the proposed notice program and appointed Simpluris as the Settlement Administrator to oversee notice and claims administration.
A Final Approval Hearing has been scheduled for December 15, 2026, at 9:00 a.m. in the United States District Court for the Northern District of Alabama. If the settlement receives final approval, eligible class members who submit valid claims may be entitled to benefits under the settlement agreement. The Court established key deadlines, including a November 13, 2026 deadline for exclusions and objections and a November 30, 2026 deadline for submitting claims.
