Petition for Rehearing En Banc Denied by Tenth Circuit in Delta Petroleum Corporation litigation

On February 29, 2014, Lead Plaintiff filed his Notice of Appeal in the consolidated class action lawsuit against the Board of Directors and Officers of Delta Petroluem, Inc. during the relevant class period.  The consolidated class action case was filed in the United States District Court for the District of Colorado and is styled Patipan Nakkhumpun v. Daniel Taylor, et al.  Lead Plaintiff was requesting that the Tenth circuit review the Order Granting Defendants’ Motion to Dismiss entered September 30, 2013 and the Order Denying Plaintiff’s Motion for Leave to Amend entered January 29, 2014.    On January 22, 2015, Federman & Sherwood presented their oral argument before the Tenth Circuit in support of Lead Plaintiff’s appeal.

On April 7, 2015, the Tenth Circuit entered its Opinion reversing the dismissal of the claim against Daniel Taylor only.  To review the Opinion entered by the Tenth Circuit, please click here.

On April 20, 2015 Appellee Daniel Taylor filed his Petition for Rehearing En Banc with the Tenth Circuit.  Appellee was requesting review of the Order entered April 7, 2015.

After briefing by the parties, the Tenth Circuit entered its Order on May 19, 2015 denying Appellee’s Petition for Rehearing.  To view the Order entered by the Tenth circuit, please click here.
