FEDERMAN & SHERWOOD ANNOUNCES FILING OF FIRST FEDERAL CLASS ACTION LAWSUIT AGAINST THE HOME DEPOT, INC. FOR CONSUMER DATA SECURITY BREACH
On September 4, 2014, Federman & Sherwood filed a class action lawsuit in the United States District Court for the Northern District of Georgia, Atlanta Division, on behalf of several consumers against The Home Depot, Inc. [NYSE: HD] (“Home Depot”). The Complaint alleges that Home Depot failed to meet its legal obligation to protect consumers’ credit card and personal information and failed to timely warn them that such information had been stolen or that the security and privacy of such information had been compromised.
It is alleged by the plaintiffs that in late April or early May, 2014, computer hackers gained access to Home Depot’s point of sale data network and stole personal and financial information for hundreds of thousands, if not millions, of Home Depot’s customers. However, Home Depot failed to tell its customers about this security breach. Only recently was the security breach brought to light by a computer security blogger, Brian Krebs, in his September 2, 2014 blog post (http://krebsonsecurity.com/2014/09/banks-credit-card-breach-at-home-depot/).
On behalf of themselves and all class members, Plaintiffs seek injunctive relief and damages suffered by class members as a result of Home Depot’s actions, including alleged violations of data breach statutes for 38 states. If you believe you have had false charges on a credit or debit card as a result of Home Depot’s data security breach, please complete the attached questionnaire and return the completed form with supporting documentation to email@example.com.
